Event Terms

These event terms (“Event Terms”) govern your participation in the Instacart Presents Third Eye Blind event scheduled to occur at Terminal 5 in New York City at 6:30PM on September 4, 2025 (collectively, the "Event") hosted, managed, promoted, or sponsored by Maplebear Inc. d/b/a Instacart (“Instacart”), and its agents, affiliates, and third party sponsors of the Event (including, without limitation, Venmo and various consumer packaged goods sponsors) and official hosts at the Event (collectively, "Authorized Parties"). By registering for or attending the Event, you understand and agree to the following:

 

Entry & Admission:

  • Admission to the Event will be on a first-come, first-serve basis. This registration to the Event is not a ticket to the Event. There may be limited capacity at the Event. Your registration for the Event does not guarantee admission. Instacart anticipates that not all registrants will be admitted to the Event. 

  • To be admitted to the Event, at entry:

    • You must be 21 years of age or older to register for and attend the Event, and shall be required to show a valid, government-issued photo ID to enter the Event. By registering for the Event, you represent that you are at least 21 years of age.

    • You must have a valid registration for the Event and unique QR code (emailed to you upon registering for the Event). 

    • You may be asked to display the downloaded Instacart app (with or without Instacart account registration) on your phone prior to admission.

  • In the event there is a waitlist for the Event, Authorized Parties may contact you via the information you provided in connection with such waitlist, but your placement on such waitlist does not guarantee admission to the Event.

  • Your registration for the Event is non-transferable to another individual. 

  • You may not bring guests to the Event, unless otherwise informed in writing by an Authorized Party.

 

Prohibited Items/Behavior:

  • You shall abide by all rules and restrictions provided by the Event venue.

  • The Authorized Parties reserve the right to refuse admission to the Event or eject any patron from the Event for any reason (including, without limitation, due to visible intoxication) at their sole discretion.

  • The following are not permitted at the Event:  

    • Outside food, beverages and alcohol

    • Weapons or weaponized props (including pocketknives and pepper spray)

    • LED Laser pointers/pens, flashlights

    • Projectile-type devices

    • Air horns, whistles, cowbells, other noise-making devices

    • Illegal drugs

    • Fireworks, smoke bombs, etc.

    • Skateboards, in-line skates, roller shoes, ice skates, etc.

    • Permanent markers, spray paint, stickers, flyers, posters, handbills

    • Two-way radios

    • Selfie sticks

    • GoPro Cameras or drones

    • Markers, spray paint

    • Smoking of any kind (including e-cigarettes)

    • Hard-case containers

    • Large backpacks, suitcases, beach bags, equipment bags, etc.

  • Should you attempt to violate this policy (or these Event Terms), you may be refused entry. Authorized Parties reserve the right to inspect persons/bags prior to entry or during Event.

 

Waiver of claims:

  • Authorized Parties are not responsible for any costs or damages in connection with your anticipated admission to the Event.

  • Event details are subject to change (including, but not limited to, entry requirements, event location, artists, talent, performances, on-site activations, time, and date) or cancellation in Instacart's sole discretion without notice. For clarity, Instacart may elect to not hold the Event for any reason or no reason, and you shall have no claim against the Authorized Parties with respect to such election.

  • Should you be admitted to the Event, you attend at your own risk. In consideration of the Authorized Parties granting you entry to the Event, you, on behalf of yourself, your heirs, executors, agents, successors and assigns, hereby fully release and hold harmless, and will not make a claim against, any Authorized Party or their respective employees, contractors, agents, directors, officers, insurers, and representatives as well as any venue owners, volunteers, or performers (collectively “The Released Parties”) for any and all damages, costs, injury, illness, disability or death arising from or related to the Event (including, without limitation, your attendance at, travel to or waiting for the Event). Further, you agree to indemnify and hold harmless the Released  Parties s from any and all claims, allegations, demands, actions, suits, proceedings, costs, expenses (including attorney fees and punitive damages)arising from or related to the Event, including, without limitation, damages, personal injury, death, and/or damage to property. Total liability of the Released Parties, if any, shall in no event exceed the price of the Event tickets purchased directly by the Participant.

 

Promotional Rights:

  • By registering for and attending the Event, you expressly consent to being photographed, filmed and/or otherwise recorded, and to have any user generated content that you create and share publicly (including, without limitation, your social media posts, chat content, profile name/imagery, etc.), photographed, filmed, recorded and/or otherwise captured, by the Authorized Parties. You grant an unlimited, royalty-free, and unrestricted license to the Authorized Parties to use any such resulting photographs, video footage or other content (including without limitation, your appearance, user generated content, image, likeness, voice, and name) (collectively, "Content"), in any and all media throughout the universe in perpetuity, for any purpose whatsoever (including without limitation, advertising and promotional purposes). You understand that all photography, filming and/or recording will be done in reliance on this consent given by you attending the Event and that you have no rights to view, approve, edit, or otherwise use or receive compensation for any of the Content or use thereof.

  • The Authorized Parties may use the name, email address, and any other information that you provide in this registration to send you (i) information or marketing communications related to the Event or Event sponsors; (ii) to provide you with technical support related to your registration; (iii) and/or as otherwise described in Instacart's Privacy Policy.

  • To the extent you've been compensated in any manner by any of the Authorized Parties to attend or post about the Event on social media, you agree to comply with all applicable rules, guidelines, laws, and regulations, including, without limitation, FTC guidelines applicable to endorsements and testimonials, and to use a designated hashtag # or a similar compliant disclosure in each such post.

 

Seizure Warning:  

  • This Event may contain visual images with light patterns, rolling images, or flashing lights, which may trigger epileptic seizures in a small percentage of individuals. Such conditions may also trigger previously undetected epileptic symptoms or seizures in individuals without prior epileptic symptoms or a history of epilepsy. If you have an epileptic condition consult your doctor prior to attending the Event. IMMEDIATELY exit the Event and consult your doctor if you experience: dizziness, altered vision or eye/muscle twitches, disorientation, loss of awareness, seizures, or any involuntary movement.

 

Miscellaneous:

  • Instacart trademarks and carrot logos are the registered trademarks of Maplebear Inc. d/b/a Instacart. All third-party logos, brand names, and trademarks referenced herein belong to their respective owners and should be attributed as such. All rights reserved.

  • As applicable, you agree to abide by Instacart's Community Guidelines, and you agree not to post, share, or create obscene, infringing, or otherwise objectionable content in or from the Event.

  • The Authorized Parties' brands or marks may be made available to you for personal, limited use(s) through various experience(s) at the Event, and the license for this use may be revoked at any time, for any reason, at the Authorized Parties' sole discretion.

  • EXCEPT AS PROVIDED BY LAW, ANY CLAIMS THAT YOU AND INSTACART HAVE AGAINST EACH OTHER, INCLUDING, WITHOUT LIMITATION, ANY CLAIMS THAT AROSE OR WERE ASSERTED BEFORE AGREEMENT TO THESE EVENT TERMS, WILL, WITH LIMITED EXCEPTIONS, BE SUBMITTED TO BINDING AND FINAL ARBITRATION ADMINISTERED BY THE AMERICAN ARBITRATION ASSOCIATION OR THE ADR SERVICES INC., DEPENDING ON WHERE YOU RESIDE. UNLESS YOU OPT OUT OF THE ARBITRATION AGREEMENT (WITHIN 30 DAYS OF ACCEPTING THESE TERMS, BY EMAILING INSTACART AT [email protected] WITH FIRST NAME, LAST NAME, EMAIL ADDRESS AND INTENT TO OPT OUT), YOU WILL ONLY BE PERMITTED TO PURSUE CLAIMS AND SEEK RELIEF AGAINST THE AUTHORIZED PARTIES ON AN INDIVIDUAL BASIS, NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY CLASS OR REPRESENTATIVE ACTION OR PROCEEDING. TO THE FULLEST EXTENT PERMITTED BY LAW, YOU ALSO WAIVE YOUR RIGHT TO SEEK RELIEF IN A COURT OF LAW AND TO HAVE A JURY TRIAL ON YOUR CLAIMS. 

  • To the extent permitted by applicable law, these Event Terms will be governed by the laws of New York, without respect to conflicts of laws principles, but excepting the above arbitration provision.

  • These Event Terms constitute the entire understanding between the parties concerning its subject matter. If any provision is deemed invalid or unenforceable, it shall not affect the validity of the remaining terms.These Event Terms may not be amended except by a written document signed by both parties.
